Texting Terms of Service

Program name: The Moody Church. Program description: Recurring SMS/MMS text messages (donation confirmations, account notifications, reminders, and related communications) delivered via the OnlineGiving.org platform.
1. CONSENT TO RECEIVE MESSAGES
By providing your mobile phone number and opting in to receive text messages from The Moody Church through the OnlineGiving.org platform, you expressly consent to receive recurring SMS/MMS text messages delivered using automated technology.
Your consent is not a condition of any purchase, donation, or other transaction. You may choose not to receive text messages and still complete donations or other transactions through our platform.
By opting in, you confirm that you are the owner or authorized user of the mobile phone number provided, and you have the authority to consent to receive text messages at that number.
2. TYPES OF MESSAGES
When opted-in, you may receive text messages (SMS/MMS) to your mobile number. These messages may include:
- Account verification codes
- Donation and transaction confirmations
- Giving reminders and announcements
- Account notifications and alerts
- Other information related to your relationship with The Moody Church
3. MESSAGE FREQUENCY AND COSTS
Message frequency varies based on your account activity, transaction history, and the preferences you have set with the organization.
Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan and any applicable charges.
You are solely responsible for any message or data charges imposed by your wireless carrier.
4. HOW TO OPT OUT
You can opt out of receiving text messages at any time. Reply HELP for help or STOP to opt-out.
Opt-out keywords (reply to any message with one of the following):
- STOP
- QUIT
- END
- CANCEL
- UNSUBSCRIBE
After you send an opt-out keyword, you will receive a confirmation message, and you will no longer receive SMS messages from The Moody Church through our platform. No further messages will be sent after the confirmation.
5. HOW TO RESUME MESSAGES
If you have previously opted out and wish to start receiving text messages again, you can text START to resume. You may also re-enable text messaging through your account settings.

- REFUND - Request a refund within 3 hours of your donation (same day)
- PROFILE - Receive a link to manage your giving profile
RECURRING GIVING
Set up recurring donations by including a frequency keyword:
- WEEKLY, BIWEEKLY, MONTHLY, QUARTERLY, YEARLY
LIST-LEVEL OPT-OUT
To unsubscribe from a specific marketing list while remaining subscribed to other messages:
- UNSUB - Unsubscribe from the most recently received list only
- STOP [word] - Same as UNSUB (e.g., "STOP ANNOUNCEMENTS")
6. HOW TO GET HELP
If you are experiencing issues with text messages or need assistance, you can:
- Reply HELP to any message you receive

7. AGE REQUIREMENT
You must be at least 13 years of age to receive text messages through our platform. By opting in to receive text messages, you represent and warrant that you are at least 13 years old.
Our text messaging service is not intended for use by individuals under the age of 13. If we learn that we have collected information from a child under 13, we will delete that information promptly.
8. PRIVACY AND DATA PROTECTION
We take your privacy seriously. Your mobile phone number and SMS opt-in consent data:
- Will NOT be sold, rented, or shared with third parties for marketing or promotional purposes
- Will only be shared with service providers (such as our SMS delivery partner) as necessary to deliver messages you have consented to receive
- Will be stored securely in accordance with our Privacy Policy

9. CARRIER DISCLAIMER
Carriers are not liable for any delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and network availability. OnlineGiving.org cannot guarantee message delivery and is not responsible for messages that are delayed, not delivered, or delivered incorrectly due to carrier network issues.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONLINEGIVING.ORG AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE TEXT MESSAGING SERVICE.
This includes, without limitation, damages for loss of data, loss of revenue, or any other damages, even if OnlineGiving.org has been advised of the possibility of such damages.
11. SERVICE PROVIDED "AS IS"
The text messaging service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. OnlineGiving.org does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
12. CHANGES TO THESE TERMS
We reserve the right to modify these Texting Terms of Service at any time. Changes will be effective immediately upon posting to our platform. Your continued use of the text messaging service after any changes constitutes your acceptance of the revised terms.
We encourage you to review these terms periodically for any updates.
13. ORGANIZATION RESPONSIBILITIES
The organization (The Moody Church) using the OnlineGiving.org platform is responsible for:
- Obtaining proper consent from all recipients before sending text messages
- Documenting and retaining records of consent
- Ensuring message content complies with all applicable laws and regulations
- Honoring all opt-out requests promptly
The organization agrees to indemnify and hold OnlineGiving.org harmless from any claims, damages, or liabilities arising from the organization's failure to obtain proper consent or comply with applicable messaging laws and regulations.
14. HOLD HARMLESS AND INDEMNIFICATION
By opting in to receive text messages, you agree to hold harmless, indemnify, and defend OnlineGiving.org LLC, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the text messaging service; (b) your violation of these Texting Terms of Service; (c) your violation of any applicable law; or (d) any dispute between you and the organization (The Moody Church) that sends you messages. This includes, without limitation, claims arising from message content, frequency, or timing where such content or conduct is determined by the organization, not OnlineGiving.org.
The organization using the OnlineGiving.org platform agrees to indemnify, hold harmless, and defend OnlineGiving.org LLC, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the organization's messaging practices, message content, or timing; (b) the organization's collection, documentation, or use of consent; (c) the organization's failure to honor opt-out or help requests; (d) any violation by the organization of applicable law, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, carrier requirements, or A2P rules; or (e) any claim by a message recipient against OnlineGiving.org that arises from the organization's conduct. OnlineGiving.org provides the platform only; the organization is solely responsible for its use of the service and compliance with law.
These hold harmless and indemnification obligations do not limit or remove any of your opt-out rights, help rights, or other disclosures required by law or set forth elsewhere in these terms.
15. ACCEPTABLE USE
You agree not to abuse the text messaging service or use it in an unlawful or abnormal manner. Prohibited conduct includes, but is not limited to: harassing the organization or its representatives; using automated systems, bots, or scripts to interact with the service in a way that could disrupt or overload it; attempting to circumvent opt-out or other system controls; or using the service for any illegal purpose. OnlineGiving.org and the organization may suspend or block access for violation of this section. This section does not limit your right to opt out (e.g., reply STOP) or to request help (reply HELP) at any time.
16. GOVERNING LAW; JURISDICTION; VENUE; ARBITRATION; CLASS WAIVER
These Texting Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the text messaging service shall be resolved exclusively by binding arbitration administered by JAMS under its then-current comprehensive arbitration rules, in the English language, in Wilmington, Delaware (or by video or telephone if agreed or required). Judgment on the award may be entered in any court of competent jurisdiction. You and OnlineGiving.org LLC waive any right to a jury trial and agree to bring claims only in your individual capacity, not as a class member or in a representative or consolidated action. There is no right or authority for any dispute to be arbitrated on a class basis or for class-wide relief. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction. Either party may also bring qualifying claims in small-claims court if they fall within that court’s jurisdiction. Any claim must be brought within one (1) year after the cause of action arises or be forever waived.
17. LIABILITY CAP; U.S. SERVICE; PRIOR EXPRESS WRITTEN CONSENT; REVOCATION; REASSIGNED NUMBERS
To the maximum extent permitted by applicable law, in no event shall the total aggregate liability of OnlineGiving.org LLC, its affiliates, officers, directors, employees, and agents for any and all claims arising out of or related to these Texting Terms or the text messaging service exceed the greater of (a) one hundred dollars ($100 USD) or (b) the amount you paid in connection with the service in the twelve (12) months preceding the claim. This cap supplements Section 10. The text messaging service is provided from the United States and is intended for users in the United States. If you access the service from outside the United States, you consent to the processing of your information in the United States and to these terms. By opting in, you give your prior express written consent to receive recurring SMS/MMS messages as described in these terms. You may revoke consent at any time by replying STOP (or any other opt-out keyword listed in Section 4) to any message; revocation is effective once we process your opt-out. You represent that you are the current subscriber or customary user of the mobile number you provided and that you have the authority to consent to receive messages at that number. You understand that consent is not valid for numbers that have been reassigned to another person.
