This privacy policy discloses what personal data we collect and how it is used. We do not sell, rent, or share your personal information (including your mobile phone number and SMS opt-in data) with third parties for marketing or promotional purposes. Details are provided in the sections below.
SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
What we collect: When you make a donation or purchase through our platform, we collect the personal information you provide such as your name, address, email address, and phone number. When you browse our platform, we automatically receive your computer’s internet protocol (IP) address.
How we use it: We use this information to process your transaction, verify your payment method, create and manage your account, and improve our platform (e.g., understanding browser and system usage). With your permission, we may send you emails about the organization you support, updates, and other relevant information. We do not use your information for third-party marketing or share it with third parties for their marketing purposes.
SECTION 2 - CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, make a donation, or create an account, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at support@onlinegiving.org or mailing us (please email us for mailing address).
SECTION 3 - SMS/TEXT MESSAGING SERVICES

OnlineGiving.org provides text messaging (SMS/MMS) services on behalf of organizations using our platform. When you provide your mobile phone number and opt in to receive text messages through The Moody Church’s giving page or account settings, you consent to receive recurring SMS/text messages from The Moody Church via the OnlineGiving.org platform.
What Messages You May Receive:
Text messages may include donation confirmations, transaction receipts, account verification codes, giving reminders, and other notifications related to your relationship with The Moody Church.
Message Frequency:
Message frequency varies based on your account activity, transaction history, and the preferences you have set with The Moody Church.
Opting Out:
You may opt out of text messages at any time by replying STOP to any message you receive. After you text STOP, you will receive a confirmation message and will no longer receive SMS messages from The Moody Church through our platform. To resume messages, reply START.

Costs:
Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan.
Carrier Liability:
Wireless carriers are not liable for delayed or undelivered messages.
Mobile Information Sharing:
We will NOT sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or personal information collected through our SMS service to any third party. Your mobile phone number will not be shared with third parties or affiliates for marketing or promotional purposes. Mobile information is used solely to facilitate the services you have requested from The Moody Church and the OnlineGiving.org platform.
SECTION 4 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
Notwithstanding the above, we do not sell, share, or disclose mobile phone numbers or SMS opt-in consent data to any third party for marketing or promotional purposes.
SECTION 5 - HOSTING AND DATA STORAGE
Our platform and your data are hosted and stored on Google Cloud. Google Cloud provides the infrastructure that allows us to offer our products and services to you. Your data is stored on secure servers behind a firewall.
Payment:
If you choose a direct payment gateway to complete your donation or purchase, then we securely forward your credit card data to our gateway vault. Your transaction data is stored securely offsite by our payment gateway provider.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our platform and its service providers.
SECTION 6 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your transaction-related activities.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Important - SMS/Text Message Services:
While we use third-party service providers such as Twilio to deliver SMS/text messages, your mobile phone number is not shared with any third party for their own marketing purposes. Third-party messaging providers only receive your phone number as necessary to deliver messages you have consented to receive.
Once you leave our platform or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Service.

SECTION 7 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with up to AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

If OnlineGiving.org is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to provide services to you.
SECTION 11 - U.S. SERVICE; AGREEMENT; INTERNATIONAL USERS
OnlineGiving.org is a United States-based service. This privacy policy is governed by the laws of the United States, without regard to conflict-of-law principles. The interpretation and enforcement of this policy are subject to U.S. law only.
By using this website or our platform, you agree to this privacy policy and to the collection, use, and disclosure of your information as described herein. If you do not agree with this policy or any part of it, you must not use this website or our services. In that case, please navigate away and discontinue use. Your continued use after any change to this policy constitutes your acceptance of the updated policy.
If you are located outside the United States, you consent to the transfer, storage, and processing of your information in the United States. You acknowledge that the service is operated from and primarily intended for the United States, and that your country's laws may differ from or conflict with U.S. law. SECTION 12 - LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, OnlineGiving.org LLC, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, this privacy policy, or the collection, use, or disclosure of your information, including but not limited to damages resulting from unauthorized access to your data (except to the extent caused by our gross negligence or willful misconduct), the actions of third parties, or events beyond our reasonable control. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the greatest extent permitted by law.
SECTION 13 - SEVERABILITY; NO WAIVER
If any provision of this privacy policy is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of this policy does not constitute a waiver of that right or provision.
SECTION 14 - GOVERNING LAW; JURISDICTION; VENUE; ARBITRATION; CLASS WAIVER
This privacy policy is governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to this policy or your use of the platform shall be resolved exclusively by binding arbitration administered by JAMS under its then-current comprehensive arbitration rules, in the English language, in Wilmington, Delaware (or by video or telephone if agreed or required). Judgment on the award may be entered in any court of competent jurisdiction. You and OnlineGiving.org LLC waive any right to a jury trial and agree to bring claims only in your individual capacity, not as a class member or in a representative or consolidated action. There is no right or authority for any dispute to be arbitrated on a class basis or for class-wide relief. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction. Either party may also bring qualifying claims in small-claims court if they fall within that court’s jurisdiction. Any claim must be brought within one (1) year after the cause of action arises or be forever waived.
SECTION 15 - LIABILITY CAP
To the maximum extent permitted by applicable law, in no event shall the total aggregate liability of OnlineGiving.org LLC, its affiliates, officers, directors, employees, and agents for any and all claims arising out of or related to this privacy policy or your use of the platform exceed the greater of (a) one hundred dollars ($100 USD) or (b) the amount you paid to OnlineGiving.org or through our platform in the twelve (12) months preceding the claim. This cap applies regardless of the form of action and supplements Section 12.
SECTION 16 - DATA RETENTION; CCPA; ACCESS; ACCEPTANCE; NO WARRANTY
We retain your information for as long as necessary to provide the platform, comply with legal obligations, resolve disputes, and enforce our agreements. We may retain certain information as required by law or for legitimate business purposes after your account is closed. We do not sell your personal information as that term is defined under the California Consumer Privacy Act (CCPA) and similar state laws; we have not sold personal information in the past twelve (12) months. Requests for access, correction, amendment, or deletion of your information will be handled in accordance with applicable law; we will respond within the timeframes required by law where applicable. This policy and our related disclosures are provided “as is”; we do not warrant that they will meet any particular standard beyond what is expressly stated herein. Your continued use of the website or platform constitutes your acceptance of this privacy policy.
